Terms of Service

These Terms of Service (“Terms”) govern your use of kuldeepkumarsaini.com and any web design/development services provided by Kuldeep Kumar (“I,” “me,” or “my”). By using this website or engaging my services, you agree to these Terms.

1. Services Provided

I provide WordPress website design, development, e-commerce (WooCommerce) setup, SEO optimization, and website maintenance/support services, as described on this website or agreed upon directly with a client.

2. Project Process

  • Projects begin after a discovery call/message and mutual agreement on scope, timeline, and price
  • A sample/draft version is built and shared for client review
  • Clients are expected to provide necessary content (text, images, logos, brand assets) in a timely manner to avoid project delays
  • Delivery timelines are estimates and may vary based on project complexity, revision rounds, or delays in receiving client feedback/content

3. Pricing & Payment

  • Prices are quoted based on project scope, as outlined in the Pricing section of this website or a custom quote
  • Accepted payment methods: PayPal, Wise, Payoneer (international clients); UPI, bank transfer (Indian clients)
  • Payment structure: 60% advance payment is required before work begins. The remaining 40% is due upon project completion, before final handover and site launch.
  • Late payments may result in project pause until payment is received
  • All prices are exclusive of any third-party costs (domain registration, hosting, premium plugins/themes, stock imagery) unless explicitly included in the quote

4. Revisions

  • Each pricing package includes a specified number of revision rounds (see Pricing page)
  • Revisions beyond the included rounds, or changes outside the original agreed scope, will be quoted and billed separately
  • Revision requests should be submitted in writing (email or WhatsApp) with clear, consolidated feedback where possible

5. Ownership & Intellectual Property

  • Upon full and final payment, the client owns the final website design, content, and custom code developed specifically for their project
  • I retain the right to showcase completed projects (screenshots, links, descriptions) in my portfolio and marketing materials, unless the client requests otherwise in writing
  • Any third-party assets used (premium themes, plugins, stock photos, fonts) remain subject to their respective licenses, which the client is responsible for maintaining/renewing after handover if applicable

6. Cancellations & Refunds

  • If a client cancels a project after work has begun, payment already made for completed work is non-refundable
  • If I am unable to complete a project due to reasons within my control, a partial or full refund will be issued based on work completed at the time of cancellation
  • No refunds will be issued for completed and delivered projects that have been approved by the client

7. Hosting & Domain

  • I do not include hosting or domain registration costs unless explicitly stated in the project quote
  • If I assist with hosting/domain setup on the client’s behalf, the client remains the account owner and is responsible for ongoing renewal costs

8. Post-Launch Support

  • Support period included with each package is outlined in the Pricing section
  • Support covers minor bug fixes and clarification on CMS usage; it does not include new feature development, design changes, or content additions unless otherwise agreed
  • Support requests after the included period may be billed on an hourly or per-task basis

9. Client Responsibilities

The client agrees to:

  • Provide accurate project requirements and timely feedback
  • Supply necessary content, images, and brand assets, or approve the use of stock alternatives
  • Ensure they have the rights to any content/images/logos provided for use on their website

10. Limitation of Liability

I am not liable for indirect, incidental, or consequential damages arising from the use of the website or services, including but not limited to loss of business, data, or revenue, except where such liability cannot be excluded under applicable law.

11. Governing Law

These Terms are governed by the laws of India. For international clients, any dispute will first be attempted to be resolved amicably through direct communication before pursuing formal legal action.

12. Changes to These Terms

I may update these Terms from time to time. Continued use of my services after changes are posted constitutes acceptance of the updated Terms.
